Those of you who used the old forum will remember catdog who posted on behalf of her Aunt and Aunt's old dog SAMMY a while ago. I did actually pm her and ask what was happening, also advised her that we were now using a new forum if she wanted to get in touch. Also Moonstone posted the old forum and asked what was happening with the case a few days ago. They have actually WON the case, got Sammy back with £1000 costs (RSPCA reckon they spent £5000 on the dog (yeah, right, I bet they did!!) Anyway, they are happy with the result. I will post again and advise them to leave the details on this site, which I already did. But fab news for Aunt and the old dog. RSPCA obviously knew they could not win the case, eh?? I may PM again and ask them to post the details on THIS forum. SOOOOO pleased for them. But £1000 when the guy with the Indian elephant (Bobby Roberts) did not even get a few hours community service, no costs (which I guess would be sky-high for something the size of elephant Anne....costs for my one healthy mare were thousands) and no ban on keeping animals altho the ponies were allegedly also abused... But so glad that Sammy will be reunited with her family after far too long!!!!! But if they should not have taken Sammy in the first place, why should the owners have to pay a PENNY? They should be compensated for the stress they have suffered. What I wanted to know was how Sammy got into RSPCA clutches in the first place, since no note was left either by RSPCA or by police. Did some snitch of a neighbour (aka "concerned member of the public") dob them in for whatever reason?

It is fantastic news, but think they should not have to pay any costs and I would be getting legal advice I think. But maybe they have had enough stress for the time being? I hope they will put some more details on this site now that it's over.

I definately think i would be after getting my costs back, maybe a small claims court would deal with it?

Agree wholehearedly Basil. i am not a lawyer but I thought..and everyone else seems to think...that if you win you win and there are no costs. But Small Claims is a good idea, there would be the bad publicity which they would not be happy about and it's easier than ever now. You can do it on-line as far as I know, or most of it anyway. I am actually considering using Small Claims Court against HSBC as their customer service has proved to be so shocking and Financial Ombudsman have been dragging their heels since the summer. I used them once and I do recall it was an easy process.

hey there everyone,

Thanks for the support and advice throughout.

I got my wires crossed just found out that the reason they had to pay is because they were found guilty. Think my aunty was a little embarrassed to tell me, but the judge saw they have not been in trouble in the past and that from all the records they took her to the vets until they were made redundant etc etc

They got her back at the weekend and she is settling back in lovely, she's getting pretty old like 13years old so I'm glad she has a nice chance to be happy and loved instead of sitting in a crappy RSPCA like she has for over six months.

it's really crap that they lost, but on a lighter note they have Sammy back.

Lucky dog indeed, if your Aunt had not got her back, she'd have been pts straight after the case was over.
