Other ways to retrieve your animals?

If your animals are taken by the police on behalf of the RSPCA an alternative to applying under Sec 20 of the ANimal Welfare Act (against whom you will be battling the RSPCA with all their financial and vet backing) you could also apply to the police under the Police (Property) Act 1897 - yes 1897! Anything taken by the police can be retrieved this way and you will be applying to courts with a summons to the police not the RSPCA. You of course have to be the legal owner of the property - if you believe you are going to be banned then sell the animals to someone shortly before your trial) So long as they can prove legal ownership then I dont think the police can refuse. They may call RSPCA as witness but in my experience the police rarely turn up when summonsed! You MUST DO this before there is a derivation order, if the court tries to issue a deprivation order your solicitor must make the court aware you no longer own the animals. Better than applying for \Sec 20 before your trial????? Its an option

When my horses were taken I was originally told by the r$pca scumbag that he was seizing them at the request of the police. As they were driven off my property he then said that they had not been seized but that I had voluntarily allowed them to be taken (over my dead body!!). Then told me that if I signed them over to them he would 'make things easier for me'.

I was offered a "deal" when i was raided the evil bitch who stole my rabbits told me that if i signed them over she would not prosecute me but if i refused then she would have me arrested i told her where to get off so she erm? read me my rights (not sure how she could do this when they have no powers) and put me under "arrest" the police she had called then kept shouting at me to sign them over as they where rspca they love animal's don't they (NOT) i shouted back that they would kill them all if they took them away they then locked me in a police car for 6 hours while they removed my pet's they even took away my phone so i couldn't call my family for help i had no access to food/water/toilet facilities so this was against human rights
